SQUARE REWARDS – OFFICIAL RULES
The square rewards system consists of Rewards. These Official Rules govern the Reward System.
Square Rewards (collectively and individually the ‘Rewards’) are open only to participants who are aged 18 or older at the time of entry. Employees (and their immediate family or household members) of InSites Compages (hereinafter: “InSites”) and the Client and each of their respective parent corporation(s), affiliates, subsidiaries, divisions and related companies and suppliers as well as its advertising, promotional and judging agencies (collectively the ‘Rewards Parties’) are not eligible to enter or win.
• ‘Immediate family members’ means parents, stepparents, children, stepchildren, siblings, stepsiblings or spouses, regardless of where they live.
• ‘Household members’ means people who share the same residence at least three months a year, whether related or not.
Rewards are subject to all applicable federal, state, provincial and local laws and regulations. Participation constitutes the entrant’s full and unconditional agreement to these Official Rules and InSites’ decisions, which are final and binding in all matters related to the Rewards. Receiving a reward is contingent upon fulfilling all requirements set forth herein. Void where prohibited.
A reward shall be obtained based on the points a participant earns. Points can be earned through completing an activity or stream of activities within a certain time frame. The Points earned will be automatically added to the participant’s balance under My Rewards Page once the activity closes. In some cases, the activities will not be sent to all participants; only participants with the desired profile will be invited. Participants will be able to attend activities until the desired number of participants is reached or the activity has closed.
The number of Points that a participant can obtain, will be communicated to the participants on the activity card and in the activity invite e-mail that the participants receive on the e-mail address provided upon registration. All guidelines on what InSites expects from the participants can be found in the “About This Project” section of the Square. In case participants fit the profile, they will get access to the specific (stream of) activities. The start of the activity or stream of activities and the schedule will always be communicated in an invitation that the participants will receive on the e-mail address they provided upon registration. Every invitation will mention the time interval applicable to take part in activity stream. Only participation within the specified time interval is taken into account in order to be eligible for earning Points.
Points will be offered to participants depending on the number of activities they completed and the quality of their responses. Participants are expected to respond to discussions, challenges or surveys that appear on the platform (except for the Lounge), in a detailed and in-depth manner. The moderator can reject incomplete or superficial answers.
Points are always whole numbers from 1 upwards. The value of a Point is different for each country so the value of a Point in local currency may have decimals. The aim is to acquire Points which can subsequently be redeemed for a reward via our reward partner. Before a number of Points can be redeemed and converted into a reward value, a certain threshold expressed in Points must be reached by the participant. It is only allowed to redeem an amount of Points which represent a whole number (without decimals). When the exchange of Points results in a reward value with decimals, the amount in local currency will be rounded down.
As we are working with a points system which does not allow having points with decimals (for eg: 0,5 points), the remaining values kept in your balance (after you have redeemed your points) will need to be converted back to equal round point numbers. For eg:
• If the remaining amount equals less than 0,50 points, the amount will be rounded down to 0 points.
• Any value equal to or higher than 0,50 will be rounded up to the value of 1 point.
Nevertheless, the remaining Points will remain in the participants’ balance in order to be redeemed later on when the threshold is reached again once new points are collected. Points and the minimum threshold can be tracked via the My Rewards page.
In case InSites has mistakenly paid a higher incentive than the amount due to the participant, InSites will inform the participant by written notice of the amount overpaid. The participant is obliged to return the overpayment to InSites within 5 days after receipt of this letter, as the overpayment constitutes an unjustified enrichment on the part of the participant.
As long as the participant is active on the square and takes part in the activities the participant is invited to, the acquired Points will remain valid.
Unless previously and explicitly stated otherwise, points will expire if the participant is inactive for at least 366 days to 6 consecutive activity invites. Only in case the participant has not responded to a minimum of 6 consecutive invitations of which minimum 1 invite was sent in the first half and minimum 1 invite was sent in the second half of the 366 days, the points will expire. The points earned expire after the 366 days have passed from the first invite the participant has not responded to if the participant has not taken action to minimum 6 consecutive invites sent in the past 366 days.
The counter shall be reset as soon as the participant has responded to an invitation. From the moment the participant does not respond to an invitation, the counter will start running again.
After a project has ended, participants can redeem Points until 6 months after platform closure. After 6 months of closure the rewards page will show that the unredeemed points have been removed from the account of the participants. In case the platform is reopened after 6 months of inactivity, the Points will no longer be available.
3. Rewards status
Vouchers are subject to their terms and conditions and may not be returned, redeemed for cash (except to the extent required by law) or used as payment on or credit to any credit card account. They are not valid on prior purchases. Rewards will not be replaced if lost or stolen. In no event will the value of the redeemed reward exceed the stated value. In the event the participant purchases more than the stated value worth of merchandise, the participant will be solely responsible for payment of those additional costs. There is no reward substitution except as may be authorized by InSites in its sole discretion. The Reward is not transferable or assignable. The participant is responsible for all taxes and fees associated with voucher receipt and/or use.
4. General conditions
The decisions of InSites with respect to all aspects of a Reward are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/ disqualification of entries and/or entrants. Any attempt by any entrant to obtain a reward by using multiple/ different e-mail addresses, identities, registrations and logins, or any other method, will void that entrant’s participation; also, that entrant may be disqualified. Use of any automated system or service to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the e-mail address used to register will be deemed to be the entrant. The ‘authorized account holder’ is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.
Vouchers have no cash value and are not transferable. InSites assume no responsibility for lost, delayed, incomplete, incompatible or misdirected replies. Rewards are subject to all applicable federal, provincial and municipal laws. InSites will not be liable for: (i) any failure of the website during an activity; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer online systems, servers, access providers, computer equipment or software; (iii) the failure of any entry or other information to be received, captured or recorded for any reason, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in an activity; and/or (v) any combination of the above. Any automated computer receipt (such as a ‘thank you’ message or one confirming delivery of entry) does not constitute proof of actual receipt by InSites of an activity completion for purposes of these Official Rules.
InSites reserves the right to withdraw, amend or suspend a reward (or to amend these Official Rules) in any way, in the event of an error, a technical problem, a computer virus, bugs, tampering, an unauthorized intervention, fraud, a technical failure or any other cause beyond the reasonable control of InSites that interferes with the proper conduct of a reward as contemplated by these Official Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of a reward in any way is a violation of criminal and civil laws and should such an attempt be made, InSites reserves the right to seek remedies and damages to the fullest extent permitted by law. InSites (if applicable), reserves the right to cancel, amend or suspend a reward, or to amend these Official Rules in any way without prior notice or obligation, in the event of any accident, printing, administrative or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the foregoing, InSites reserves the right to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with the applicable law. InSites reserves the right, in its sole and absolute discretion and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Official Rules, to the extent necessary, for purposes of verifying compliance by any entrant or entry with these Official Rules, or as a result of any technical or other problem, or in light of any other circumstances affecting the proper administration of a reward as contemplated in these Official Rules, or for any other reason.
In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any rewards-related materials, including, but not limited to: the entry form, the website, these Official Rules, or advertising, the terms and conditions of these Official Rules shall prevail, govern and control to the fullest extent permitted by law.
5. Governing law and disputes
These Official Rules and the Rewards are governed by the general laws of Belgium and, for each participant, by the specific laws of the jurisdiction within the Square in which that participant is resident. The courts of each jurisdiction of Belgium shall have jurisdiction in respect of all issues and questions concerning the construction, validity, interpretation and enforceability of the Rewards Official Rules, or the rights and obligations of the entrant and InSites in connection with the Rewards.
All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules or the rights and obligations of entrants or InSites in connection with the rewards shall be governed by and construed in accordance with the internal laws of Belgium without giving effect to any choice of law of conflict of law rules or provisions that would cause the application of any other state’s laws.
The Rewards and any dispute arising under it or related thereto will be governed by the relevant law of Belgium and the relevant courts of Belgium shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Rewards or these Official Rules.
